These Terms of Service (“Terms”) govern your access to and use of lostmytooth.com, toothfairydept.com, and all related services (collectively, the “Service”) operated by toothfairydept.com (“we,” “our,” or “us”). By accessing or using the Service, you agree to be bound by these Terms.
1.Eligibility and Accounts
You must be at least 18 years of age to create an account and use the Service. By creating an account, you represent that you are the parent or legal guardian of any child for whom you register a profile on the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
2.Description of Service
The Tooth Fairy Department is an entertainment service that creates personalized, fictional tooth fairy experiences for children. All content presented on the Service — including fairy characters, inspection reports, departmental branding, registry entries, and statistical displays — is fictional and created for entertainment purposes. The Service is not affiliated with any government agency, dental organization, or regulatory body. All “registrations,” “files,” “department records,” and similar elements are part of the fictional experience.
3.Subscriptions and Payments
3.1Pricing Tiers
We offer the following pricing options:
- Single Tooth Event — $3.99 per event
- Annual Magic Pass — $29.99 per year, auto-renewing
- Complete Tooth Journey — $59.99, one-time lifetime purchase per child
- Family Plan — $89.99, one-time lifetime purchase for up to 4 children
Prices are subject to change with 30 days' notice. Existing subscriptions will not be affected by price changes until their next renewal period.
3.2Payment Processing
All payments are processed securely through Stripe. We do not store your credit card details. By providing payment information, you authorize us to charge the applicable fees.
3.3Refund Policy
Single Tooth Events: Refundable within 48 hours of purchase if no tracking slip has been downloaded or printed.
Annual Subscriptions: Prorated refund available within the first 30 days. No refunds after 30 days.
Lifetime Purchases: Refundable within 30 days of purchase if fewer than 2 tooth events have been logged.
We reserve the right to issue refunds outside these windows at our discretion.
3.4Cancellation
Annual subscriptions may be cancelled at any time through your account dashboard. Cancellation takes effect at the end of the current billing period. You will retain access to existing child profiles and data after cancellation, but will not be able to log new tooth events or generate new content without an active subscription.
3.5Upgrade Credit
If you purchased a Single Tooth Event and subsequently upgrade to an Annual or Lifetime plan, the amount of your most recent Single Tooth purchase will be credited toward the upgrade price.
4.User Content and Conduct
You are responsible for all information you provide through the Service, including child names, tooth event descriptions, dental habit notes, and any other optional fields. You agree not to submit content that is: false or misleading in a way that could harm others; offensive, abusive, or inappropriate; infringing on any third party's rights; or in violation of any applicable law. We reserve the right to remove any content that violates these Terms and to suspend or terminate accounts that repeatedly violate our policies.
5.Intellectual Property
5.1Our Content
The Service and its original content, features, and functionality are owned by toothfairydept.com and are protected by copyright, trademark, and other intellectual property laws. This includes but is not limited to: the Tooth Fairy Department brand, name, logo, and associated design elements; all fairy character names, personalities, backstories, and illustrations; the tracking slip designs, tooth map illustrations, and page layouts; the progressive lore and fictional world-building content; the classified login experience design; all AI-generated content produced by the Service.
“The Tooth Fairy Department,” “Lost My Tooth,” and associated logos are trademarks of toothfairydept.com. You may not use these marks without prior written permission.
5.2Your Content
You retain ownership of any original content you provide (such as descriptions of how a tooth was lost or dental habit notes). By submitting content to the Service, you grant us a limited, non-exclusive license to use that content solely for the purpose of providing and improving the Service, including generating personalized AI content.
5.3Keepsake Templates
Keepsake book templates generated by the Service are for your personal, non-commercial use only. You may print and share physical copies with family members. You may not redistribute, sell, or commercially exploit the templates or their contents.
6.AI-Generated Content
The Service uses artificial intelligence to generate personalized content including fairy inspection notes, flight logs, and farewell letters. While we implement safety filters and quality controls, AI-generated content may occasionally contain inaccuracies or unexpected phrasing. We review content through automated filters but do not manually review every generated piece. By using the Service, you acknowledge that AI-generated content is fictional entertainment and should not be relied upon for dental health advice or any other professional guidance.
7.Service Availability
We strive to maintain consistent availability of the Service but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control. For child-facing pages, we aim to ensure availability during peak hours (evenings and early mornings in US time zones) when children are most likely to access their fairy files.
8.Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy for detailed information about how we collect, use, and protect your information.
9.Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. THE FICTIONAL CONTENT PROVIDED BY THE SERVICE, INCLUDING AI-GENERATED FAIRY NOTES AND DENTAL COMMENTARY, IS FOR ENTERTAINMENT PURPOSES ONLY AND DOES NOT CONSTITUTE DENTAL OR HEALTH ADVICE.
10.Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOOTHFAIRYDEPT.COM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
11.Indemnification
You agree to indemnify and hold harmless toothfairydept.com and its officers, directors, employees, and agents from any claims, damages, or expenses arising from: your use of the Service; your violation of these Terms; your violation of any third party's rights; or any content you submit through the Service.
12.Dispute Resolution
Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in California. You agree to waive any right to a jury trial or to participate in a class action lawsuit.
13.Termination
We may suspend or terminate your account at any time for violation of these Terms, with notice where practicable. Upon termination: you will lose access to the Parent dashboard and the ability to log new events; existing child fairy file pages will remain accessible via magic links for 90 days to allow children to view their records; after 90 days, all data will be permanently deleted in accordance with our Privacy Policy.
You may terminate your account at any time through the dashboard. Data deletion follows the process described in our Privacy Policy.
14.Changes to Terms
We may modify these Terms at any time. We will provide at least 30 days' notice of material changes via email and/or notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
15.Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.
16.Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
