This Copyright Notice and DMCA Policy governs all content published on toothfairydept.com and any associated services operated by The Tooth Fairy Department (“we,” “our,” or “us”). We respect intellectual property rights and expect users to do the same.
1.Copyright Ownership
All content on this Service, including but not limited to text, graphics, logos, fairy character designs, AI-generated fairy reports, tracking slip designs, tooth map illustrations, and software code, is copyright © 2026 toothfairydept.com. All rights reserved. Unauthorized reproduction, distribution, or modification of any content from this Service is strictly prohibited without prior written permission.
2.AI-Generated Content
Fairy inspection notes, flight logs, and personalized reports are generated by artificial intelligence for each individual user. While the underlying AI model is provided by Anthropic, the creative prompts, character designs, narrative frameworks, and output curation are original works of toothfairydept.com and are protected by copyright accordingly.
Users retain no copyright in AI-generated content specific to their child's profile. Such content is created solely for the personal use of the registered family within the Service and may not be reproduced, distributed, or published beyond the permitted uses described in Section 4.
3.User Content
Parents retain ownership of notes, memories, and other original content they submit through the Service. By submitting content, Parents grant toothfairydept.com a non-exclusive, royalty-free, worldwide license to use, store, display, and process that content solely for the purpose of providing the Service to the submitting family. This license terminates upon deletion of the Parent's account and associated data.
4.Permitted Use
Parents may make personal, non-commercial use of the following content generated for their child's fairy file:
- Printing tracking slips, fairy reports, and keepsake materials for personal family use;
- Sharing screenshots or prints of your child's fairy report with immediate family and friends;
- Posting screenshots of your child's fairy report on personal social media accounts in a non-commercial context.
All other uses require prior written permission from toothfairydept.com.
5.Prohibited Use
The following uses of our content are expressly prohibited:
- Commercial reproduction, distribution, licensing, or sale of any content from the Service;
- Modification, adaptation, or creation of derivative works based on our content, character designs, or narrative frameworks;
- Scraping, automated collection, bulk downloading, or systematic extraction of content from the Service;
- Creating competing services, products, or offerings that incorporate, imitate, or are substantially derived from our content;
- Removing, altering, or obscuring any copyright, trademark, or other proprietary notices contained in the Service.
6.DMCA Takedown Procedure
If you believe that content on our Service infringes your copyright, you may submit a takedown notice pursuant to the Digital Millennium Copyright Act (17 U.S.C. § 512) by sending a written notice to [email protected]. Your notice must include all of the following:
- Identification of the copyrighted work you claim has been infringed, or if multiple works are covered by a single notice, a representative list of such works;
- Identification of the material you claim is infringing and that you request be removed, with sufficient detail for us to locate it on the Service (e.g., a URL);
- Your contact information, including your name, mailing address, telephone number, and email address;
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner;
- Your physical or electronic signature.
We will process valid DMCA notices promptly and take appropriate action, which may include removing or disabling access to the allegedly infringing material.
7.Counter-Notification
If material you submitted has been removed in response to a DMCA takedown notice and you believe the removal was the result of a mistake or misidentification, you may submit a counter-notification to [email protected]. Your counter-notification must include:
- Identification of the material that was removed and the location at which it appeared before it was removed;
- A statement, made under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification;
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who filed the original DMCA notice or their agent;
- Your physical or electronic signature.
Upon receipt of a valid counter-notification, we will forward it to the original complainant and may restore the removed material after the statutory waiting period unless the complainant files a court action.
8.Repeat Infringers
It is our policy to terminate, in appropriate circumstances, the accounts of users who are determined to be repeat infringers of the intellectual property rights of others. We reserve the right to make this determination at our sole discretion based on the totality of information available to us.
